Delhi High Court Injunction Against Chinese Company for Unethical Business Practices and Infringing Falcon Autotech’s Patent
The Delhi High Court has granted an injunction against Kengic Intelligent Technology, a Chinese firm, for its blatant infringement of Falcon Autotech’s patent and for failing to adhere to legal standards of business practice.
The legal battle between Falcon Autotech and Kengic has reached a significant juncture with the Court’s decision to impose an interim injunction against the latter. This move is a response to Kengic’s alleged infringement of Falcon Autotech’s patent, No. 410846, titled “AN INTEGRATED PRE-SORTATION SYSTEM,” which was granted by the Indian Patent Office on January 25, 2021.
According to Falcon Autotech’s claims, Kengic, despite being aware of the patent’s existence, has been operating a sorter machine at a client’s facility in Gurugram that closely mirrors the patented technology. An inspection by Falcon’s team revealed that the machine in question is functionally identical to Falcon’s highest-selling sorter, covered under the patent. This has led to allegations that Kengic not only copied the technology but engaged in reverse engineering to replicate Falcon’s patented system.
The Delhi High Court’s decision highlights a broader issue of unethical business practices prevalent among certain international companies operating in India. Kengic’s actions reflect a concerning trend where foreign entities engage in intellectual property theft, undermining innovation and legal protections intended to foster fair competition. Such practices not only violate patent laws but also harm the business ecosystem by creating an uneven playing field.
The Court’s interim injunction orders Kengic to cease using and distributing the infringing machines immediately. Additionally, Falcon Autotech has sought a permanent injunction, the surrender of infringing products, and financial damages for the unauthorized use of its technology.
